Ordering under this contract is available to the Department of Defense and other Federal agencies. There are three distinct ways in which task orders can be awarded under the Encore contracts. Awards can be made following a fair opportunity competition among all Encore awardees, including both full and open and small business set-aside contractors (that are qualified in the task areas applicable to the requirement). Lastly, awards can be made as “sole source” when one of the exceptions to fair opportunity applies:

  1. The agency need for services is of such urgency that providing such opportunity would result in unacceptable delays.
  2. Only one such awardee is capable of providing such services required at the level of quality required because the services ordered are unique or highly specialized.
  3. The order should be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to a TO already issued under this contract, provided that all multi-awardees were given fair opportunity to be considered for the original order.
  4. It is necessary to place an order to satisfy a minimum guarantee.
